Terms & Conditions
How these Terms work
These Terms have two parts:
- General Terms (Sections 1β19) β apply to every booking with Ocean Earth Travels.
- Product Schedules (AβG) β additional terms specific to the type of trip you book (liveaboard, day diving, course, land tour, accommodation, custom trip, transport). Where a Product Schedule differs from the General Terms, the Product Schedule applies for that booking.
For every booking we issue a Travel Agreement setting out the specific itinerary, price, payment schedule and cancellation terms for your trip. You approve and sign it (and we counter-sign) at the time of reservation. The signed Travel Agreement is the source of truth for the commercial specifics of your booking and prevails over both the General Terms and the Schedules where they conflict. These published Terms provide the overall framework that applies in addition to it.
Effective date: 1 January 2026. We may update these Terms; the version in force is the one published at the time of your booking.
PART 1 β GENERAL TERMS

2. Definitions
- Supplier / Operator β the third party actually providing a service (liveaboard owner, dive centre, hotel, transport company, park authority).
- Lead traveller β the person who makes the booking and is responsible for all members of the party.
- Booking confirmation β the document/email we issue once a deposit is received and the booking is accepted.
- Departure β the start date/time of the first booked service.
3. Booking & contract
3.1 A booking is requested when you accept a quote or itinerary. At reservation we issue a Travel Agreement (Section “How these Terms work”) that you and we both sign, setting out your specific price, payment schedule and cancellation terms. A binding contract is formed when we (a) receive your deposit and (b) issue a Booking Confirmation / countersigned Travel Agreement.
3.2 The lead traveller confirms they are 18+ and authorised to book for all party members, and that all details provided (names as per passport, certifications, medical information) are accurate.
3.3 You are responsible for checking your Booking Confirmation immediately and notifying us of any error within 48 hours.
4. Prices, currency & payment
4.1 Prices are quoted in IDR or EUR as shown on your quote. Where a EUR price is settled in IDR (or vice-versa), the exchange rate applied is the one in effect on the payment date.
4.2 We accept payment via Xendit (card, virtual account, e-wallet) and bank transfer. Card/processing fees, where applicable, are shown before payment.
4.3 The specific payment schedule for your trip is set out in your signed Travel Agreement. Our typical default (where the Travel Agreement is silent) is:
- 30% deposit to confirm the booking;
- 70% balance due 30 days before Departure.
Bookings made within 30 days of Departure are payable in full.
4.4 If the balance is not received by the due date, we may treat the booking as cancelled by you and apply the cancellation charges in Section 6 / the relevant Schedule.
4.5 Prices may change before a contract is formed. After confirmation, prices are fixed except for increases imposed by third parties beyond our control β notably government taxes, national park and conservation fees, and fuel surcharges (see Section 13).
5. Our role β agent vs. principal
5.1 For many products (liveaboards, hotels, certain expeditions, transport), OET acts as a booking agent for the Supplier. Your trip is also subject to that Supplier’s own terms and conditions, which we will make available on request and which may include stricter payment and cancellation rules than our defaults. We are not liable for the acts, omissions or default of a Supplier beyond our role as agent.
5.2 For services we operate or directly assemble (e.g. certain guided dives, bespoke itineraries, our own staff and guiding), OET acts as principal.
5.3 Your Booking Confirmation / Schedule will indicate which terms govern each component.
6. Changes & cancellations by you
6.1 All change or cancellation requests must be made in writing to [email protected] and take effect on the date we receive them.
6.2 Amendments (name changes, date shifts, itinerary tweaks) are subject to availability and any Supplier charges.
6.3 The cancellation terms that apply to your trip are those set out in the Travel Agreement you signed at booking. As a general guide, cancellation charges increase the closer you cancel to Departure, up to 100% of the trip price for late cancellations and no-shows, and your deposit is generally non-refundable.
6.4 Where Supplier terms impose higher or earlier cancellation charges (common for liveaboards, peak-season cabins and discounted accommodation), those charges apply and will be reflected in your Travel Agreement.
7. Changes & cancellations by us or a Supplier
7.1 We plan itineraries carefully but occasionally must make changes. Minor changes (e.g. dive site order, equivalent vessel/room, timing) do not entitle you to a refund.
7.2 For a significant change (e.g. material change of vessel category, destination, or a cancellation by us for reasons other than Force Majeure or your default), we will offer, where possible: (a) an alternative of comparable standard, (b) a credit/reschedule, or (c) a refund of monies paid for the affected component, less unrecoverable third-party costs.
7.3 Except as required by law, our liability for a change or cancellation is limited to the amount you paid us for the affected service.
8. Force majeure
We are not liable for failure or change caused by events beyond our reasonable control, including natural disaster, adverse weather and sea conditions, volcanic activity, epidemic/pandemic, government action or travel restriction, war, civil unrest, strikes, port or border closures, and Supplier insolvency. In such cases we will act reasonably to reschedule or recover refundable costs, but amounts already paid to and retained by Suppliers may be non-refundable.
9. Reschedule policy
If government-imposed travel restrictions prevent you from travelling to the booked destination, you may reschedule within 6 months (180 days) of the original Departure at no OET administration charge; payments made are credited to the new dates. Supplier price differences, seasonal supplements and any Supplier re-booking fees remain payable.
10. Your responsibilities
10.1 Travel documents β valid passport (with sufficient validity/blank pages), visas, and any permits are your responsibility. We are not liable for refused entry or missed services due to inadequate documentation.
10.2 Health & vaccinations β you are responsible for meeting health and vaccination requirements for Indonesia and your itinerary.
10.3 Timeliness β you must arrive at meeting/check-in points on time. Missed departures due to your own late arrival or missed connections are non-refundable.
11. Health, fitness, diving certification & medical fitness
11.1 Many of our trips are physically active and take place in remote marine environments. You must be in suitable health and disclose any relevant medical condition at the time of booking.
11.2 For all scuba diving you must:
- hold a recognised certification (PADI, SSI, or equivalent) appropriate to the dives booked, and present your certification card and (where required) logbook;
- complete a diver medical statement; where it indicates a condition, a physician’s sign-off may be required before diving;
- meet any minimum logged-dive / experience requirement stated for advanced sites and liveaboards.
11.3 No-fly rule β you must observe a minimum surface interval before flying (generally 18β24 hours). Itineraries are planned accordingly; do not book flights that conflict with this guidance.
11.4 We (and the Supplier’s divemaster/skipper) may refuse or curtail participation on safety grounds, including insufficient certification, unfit condition, or being under the influence of alcohol/drugs. No refund is due where participation is refused on these grounds.
12. Travel & dive insurance
12.1 Comprehensive travel insurance is strongly recommended for all trips.
12.2 For any trip including scuba diving, dive-specific accident insurance (e.g. DAN) covering hyperbaric treatment and evacuation is required. You may be asked to provide policy details before diving.
12.3 We can liaise with your insurer in the event of an accident, emergency or cancellation, but we are not your insurer and accept no liability for uninsured losses.
13. National park, conservation & government fees
13.1 Marine parks and protected areas (e.g. Komodo National Park) charge entry, ranger, harbour and activity fees set by government/park authorities. These are subject to change without notice and are payable by you in addition to the trip price unless your itinerary explicitly states they are included.
13.2 If such fees are increased or newly introduced after booking, the difference is payable by you. See our Komodo National Park Fees page for current guidance.
14. Assumption of risk & limitation of liability
14.1 Diving, snorkelling, boat travel and adventure activities carry inherent risks that cannot be eliminated, including risks of injury, illness or death, and of loss or damage to property. By booking you acknowledge and voluntarily accept these risks for yourself and your party.
14.2 We are not liable for loss, injury or damage caused by: your own act or omission; a third party unconnected with the booked services; or unforeseeable/unavoidable events (Force Majeure).
14.3 To the maximum extent permitted by Indonesian law, our total liability arising from a booking is limited to the price you paid us for the affected services. Nothing in these Terms excludes liability that cannot lawfully be excluded (e.g. death or personal injury caused by our proven negligence).
14.4 We are not liable for indirect or consequential loss.
15. Conduct, safety & operator authority
The skipper, guide or divemaster has final authority on safety. You must follow briefings and reasonable instructions. We/the Supplier may remove from an activity or trip, without refund, any guest whose behaviour endangers themselves, others, the vessel, or the marine environment.
16. Complaints
If a problem arises during your trip, report it immediately to our staff or the on-site Supplier so it can be addressed at the time. If unresolved, email [email protected] within 30 days of trip end with your booking reference and details.
17. Data protection
We process personal data in accordance with our Privacy Policy (oceanearthtravels.com/privacy-policy), including sharing necessary details (names, certifications, medical/dietary information) with Suppliers to fulfil your booking.
18. Governing law
These Terms are governed by the laws of the Republic of Indonesia, and disputes are subject to the jurisdiction of the competent courts of Denpasar, Bali.

PART 2 β PRODUCT SCHEDULES
Each Schedule adds to or overrides the General Terms for that product type. The specific cancellation ladder of the Supplier (stated on your quote/Confirmation) prevails where stricter.
Schedule A β Liveaboard Cruises & Dive Expeditions
- Payment & cancellation: as set out in your Travel Agreement. Liveaboard operators commonly require earlier payment and stricter, often non-refundable cancellation than our defaults, especially in peak season and for charters.
- Requirements: valid certification + logbook; minimum logged dives where stated; completed diver medical statement; DAN or equivalent dive insurance mandatory.
- Cabin pricing is per-person on shared-twin basis unless a single supplement is paid. We may pair solo travellers of the same gender or apply a single supplement.
- Itinerary & dive sites are indicative and subject to weather, sea state, currents and park access; the cruise director may alter routing for safety.
- Fuel surcharges & park fees may apply on top of the cruise price (Section 13).
Schedule B β Day Diving, Fun Dives & Snorkelling
- Payment & cancellation: as set out in your Travel Agreement; late cancellations and no-shows are non-refundable.
- Weather/safety cancellation by us: if conditions are unsafe we will offer an alternative site, reschedule or refund of the affected dive(s); we are not liable for incidental costs (e.g. transport, accommodation).
- Requirements: certification appropriate to the site; medical self-declaration; non-divers/snorkellers must follow guide instructions and basic swimming ability is assumed.
Schedule C β Dive Courses / Learn to Dive
- Conducted under the standards of the certifying agency (PADI/SSI or equivalent).
- Medical questionnaire is mandatory; a doctor’s clearance may be required before in-water training. Minimum age and prerequisites apply per course.
- Certification is not guaranteed: it is awarded only on meeting all agency performance requirements. If you need extra sessions to reach standard, additional fees may apply.
- Materials/e-learning & agency certification fees are non-refundable once issued/activated.
- Payment and cancellation terms are as set out in your Travel Agreement; missed sessions due to your fitness-to-dive, late arrival or no-show are non-refundable.
Schedule D β Land Tour Packages & Day Tours
- Inclusions/exclusions are as listed on your itinerary; items not listed (meals, tips, optional activities, personal expenses) are excluded.
- Payment and cancellation terms are as set out in your Travel Agreement.
- Transport timings are estimates subject to traffic, road, ferry and weather conditions.
Schedule E β Accommodation (Hotels & Resorts)
- Booked as agent; the hotel/resort’s own terms (deposit, cancellation, check-in/out, no-show, incidentals, damage) apply and are often non-refundable on discounted rates. These are reflected in your Travel Agreement.
- Star ratings, photos and descriptions are provided by the property; we are not liable for changes to property facilities.
Schedule F β Create-Your-Own / Bespoke Trips
- Bespoke trips bundle multiple Suppliers, so your Travel Agreement may set out mixed payment and cancellation terms for different components. You approve and sign it before confirmation and it prevails over conflicting General Terms/Schedules.
Schedule G β Ferry & Transport Tickets
- Booked as agent for the transport operator; tickets are generally non-refundable and non-changeable once issued.
- Schedules, routes and vessels are set by the operator and may change or be cancelled (weather, mechanical, operational) without OET liability; we will assist with rebooking where the operator allows.
